October 15th, 2004 

Today, Judge Stephen Mitchell ruled on the Company’s 1113(e) motion. The judge agreed to interim relief of a 21% reduction of wages for a period of four months, effectively immediately through February 15, 2005. He also agreed to allow outsourcing of the Airbus heavy maintenance for four months. He also eliminated minimum aircraft provision for all labor groups for the next four months. 

The Negotiating Committee has been continuing to meet and has been working on a Transformation Agreement as it would not have been prudent to continue working on an interim agreement not knowing how the judge would rule. We expect to meet with the Company again sometime next week in an effort to reach a Transformation Agreement as soon as possible.
