Dear Members, There are some
flight attendants who are confused about being awarded/approved for the VFLR
Agreement and Release of claims (the Release) that needs to be executed and
delivered to the Company. Below is taken from the exact language in the T/A
page 28:
8. The Release
shall provide, inter alia, that the flight attendant (i) has been given a
period of 45 days within which to consider the Release, although the flight
attendant need not take all 45 days and may choose to voluntarily execute the
Release earlier, and (ii) for a period of seven (7) days following the
execution of the Release, may revoke the Release. The Release shall not be
effective or enforceable until this revocation period has expired. The Company
shall provide flight attendants the information required under the Age
Discrimination in Employment Act of 1967, Section 626(f)(1)(H).
This means
that those who have been awarded the VFLR will receive the $10,000 once the
awardee executes and delivers the Release documents. If you take the 7 days
after execution of the Release to rescind the Release, you are forfeiting the
$10,000 NOT the VFLR. The company is basically giving you the $10,000 to
execute a Release document that protects the company from any and all
litigation or lawsuit that may arise, past, present and future claims. There
is no rescinding of the VFLR once awarded. All flight attendants had 45 days
to consider the VFLR and rescind the application during the open enrollment
period. There is a company packet that will be going out to the June awardees
shortly detailing this information along with COBRA and unemployment benefit
information.
I wrote out to
you previously about the "Release" and that the $10,000 is not
considered a "buy out", or "severance package" as you are
not separating from the company. You have "recall rights" after ALL
involuntary furloughees have been recalled. Please reread the section in the
T/A regarding this. If you have any questions or confusion, please contact
your local AFA representatives.
