FIRST SICK CALL IN A CALENDAR YEAR TO PAY 100% PAY/CREDIT
During the final stages of the Company's bankruptcy case AFA was asked to endorse the Plan of Reorganization the Company presented to the bankruptcy court. In order to support the plan The Union sought and gained several enhancements to the 2004 Flight Attendant Agreement. One of those enhancements, Flight Attendants would receive 100% pay and credit for the first sick occurrence originating in a calendar year up to a maximum of four consecutive calendar days. All subsequent sick calls would be paid at 70% pay 100% credit. As part of the agreement the Company and the Union agreed to have this provision targeted for implementation by January 1, 2006, but in no case later March 31, 2006. The Company will implement this provision as agreed on March 1, 2006 and it will become effective on April 1, 2006.
The first sick occurrence up to a maximum of four consecutive days from April 1, 2006 through December 31, 2006 will be paid at 100% pay and credit. It does not matter if you have already called in sick this year. The calendar year will begin again on January 1, 2007.
For example:
- A Flight Attendant calls in sick for a four day trip on April 1-4. All four days would be paid at 100% pay/credit.
- A Flight Attendant calls in sick for a series of trips beginning on April 1, 2006, i.e., two- two day trips back to back. In this example all four days would be paid at 100% pay/credit by virtue of the fact the sick call was one occurrence and the 4 days were consecutive.
- A Flight Attendant calls in sick for a three day trip on April 1-3 and then has two off days, April 4-5, and then calls in sick for a one day trip April 6. In this example only the first three day trip will be paid at 100% pay/credit. The one day trip will be paid at 70% pay 100% credit.
The key words to remember are "four consecutive
days".

Subject: Sick Pay change
As per the contractual language quoted below, the provision to pay 100% pay and credit for the first sick occurrence originating in a calendar year up to a maximum of four (4)consecutive calendar days will be in effect as of April 1, 2006. The applicable contractual language is as follows: Effective January 1, 2005, all sick time will be paid at seventy percent(70%)pay, one-hundred percent (100%) credit, with the sick claim hours charged at one-hundred percent (100%) against the flight attendant's sick account. As an exception to the above, the Company agrees to pay sick time at 100% pay and credit for the first sick occurrence originating in a calendar year up to a maximum of four (4consecutive calendar days. Each sick claim thereafter in the calendar year will be paid at 70%. If this provision is implemented after January 1, 2006, the occurrence that will be paid at 100% during calendar year 2006 pursuant to this provision will be the first sick occurrence following the date of implementation. What this means to you is that for your first sick call originating on or after April 1, 2006 will be paid to you at 100% pay and credit, up to a maximum of four (4) consecutive calendar days. Any additional sick time claimed for the remainder of the calendar year will be paid at seventy percent (70%) pay, one-hundred percent (100%) credit, with the sick claim hours charged at one-hundred percent (100%) against the your sick bank. This provision will be reset yearly with an effective date on the first day of the calendar year. If you have any questions, please contact your InFlight Supervisor. Thank you.
