Dear Members,

During the last few months, the Company and the MEC Officers went into discussions on two issues regarding out-of-base trips that the only leg flown for the day was a Deadhead. First issue was f/as who would fly out of base on a DH only would receive 50% for the entire day just to be in position to take published trips in other bases the next day. Many of these DH flight had less than 1:30 minutes flying time which yielded less than 1:00 pay; no credit. Sometimes this out-of-base would constitute 5 or 6 days of flying.

Subsequent to negotiations, additional clarifications regarding deadhead were made between the parties and are stated below. These are slight enhancements to the existing language and are only applicable in these instances below. This went into effect April 11, 2005:

Example 1: FA Smith is being split onto a trip. FA Smith's first day consists solely of a 1:30 hour deadhead flight and then she will overnight to be in position to pick up the remainder of the trip starting the next day. In this scenario. FA Smith would receive NO credit for her deadhead but she will receive CREDIT :30 (2:00 hrs minus 1:30 hrs). In terms of PAY, although she is only receiving :45 pay from her deadhead, she will also be made whole to the 2:00 hrs minimum pay. Bottom line: Is that CREDIT equals :30 minutes and pay equals 2:00 hrs.

Example 2: FA Jones is being split on to a trip. FA Jones first day consists solely of a 2:30 hour deadhead flight and then he will overnight to be in position to pick up the remainder of the trip starting the next day. In this scenario, FA Jones would receive NO credit for his deadhead nor would any credit be added to this day since the 2:30 hr deadhead EXCEEDS 2:00 hrs. In terms of pay, although he is only receiving 1:15 hrs pay from his deadhead, he will be made whole to the 2:00 hrs. minimum pay. Bottom line is that his credit equals zero and pay equals 2:00 hrs.

WORKING OUT OF BASE TRIPS WITH IN-BASE CREWS:
If a flight attendant is deadheading to/from another domicile to work an out-of-base trip in its entirety, the flight attendant will be paid NO LESS than the in-base flight attendants working the trip in its entirety.

Example: FA Williams is a PIT based flight attendant who is working a PHL based 2-day trip in its entirety consisting of a PHL-SJU leg on day one and a SJU-PHL leg on day two. For illustrative purposes, let's say the PHL-SJU leg on both days is worth 3:50 each actual flight time. A VM claim on each day would bring the trip total to 10:00 hrs. FA Williams deadheads to PHL from PIT on day one and deadheads back to PIT after the SJU-PHL leg on day 2. The deadheads are each blocked for 1:10 hrs. If we applied the negotiated language to this scenario as written, being deadhead time is NO credit and only Paid at 50%, FA Williams would make less than the PHL crew working the same trip (excluding the DH)This is because FA Williams would only receive credit for the actual block time of 7:40 hrs and pay of 8:50 hrs (7:40 plus 50% of 2:20 hrs (total of both deadheads) In this scenario, the Company has recognized the disparity and has agreed to pay an additional 1:10 hrs of pay so that FA Williams receives a total for the pay to 10:00 exactly what her PHL counterparts were paid.

AFA is under the assumption that even though these enhancements have been instituted, and agreed by the Company, they in no way forfeit our rights to have our side letter honored regarding the Deadhead ALPA Dispute, if ALPA should win.

Hope this helps. Keep in mind again this went into effect on April 11, 2005, and is not retroactive.
