Dear Members,

The information below is regarding the process by which to rescind you retirement if you wish to do so. This information was gathered by the LECP from CLT, Mike Flores and is for your information.

PROCEDURE TO RESCIND RETIREMENT NOTIFICATION

In order to rescind a retirement notification you must notify the USAirways Benefits Center, Inflight Administration and the PBGC. As there is presently no official form to use so you can either send a copy of your original retirement notification with the word RESCIND clearly marked at the top or draft a letter stating your intentions. With either choice make sure your name and employee number are included. You can fax your request to:

Inflight Administration--- (412) 472-1473 attention: Rick Carpenter

You must also contact the PBGC to state your decision to rescind at (800) 400-7242.

It is suggested you follow up your request with a phone call to Rick Carpenter at (412) 472-1440.

Please be aware that if you have submitted a request to retire in order to participate in the Early Retirement Incentive (ERI) and you choose to rescind your retirement you will forfeit the ERI in its entirety.

Contract Violation Grievances for Reserves regarding their PCL days & Emergency Personal Days

Dear Members,

Two Violations:

Violation 1:

The MEC has been in discussions with the Company and among each other regarding the Reserve Emergency Personal Days and how they are being charged when the reserve does not break guarantee. The company and AFA do not agree on the method used by the Company for charging f/as for these types of contracted days and we need documentation from you when you use an Emergency Personal Day. Please highlight the charge on your pay stub white pay form and fax to 412-262-2310, with a note of when you used an emergency personal day and the amount charged to your guarantee attn: Teddy Xidas.

Violation 2:

Also, we have discovered in these conversations that the Company is also violating our collective bargaining agreement by charging reserves who use FMLA/PCL days (personal care intermittent days) in blocks of a min. of 5 days either 2:22 or 2:17 minutes depending on the number of days in a month. Since the PCL days are taken in min. blocks of 5, the Company has arbitrarily taken the liberty of assessing even those days you are normally off or on INV.

For example: If you have July 1-5 as designated PCL days in a 30-day month and since the PCL is in consecutive blocks of min. 5 days, the Co will charge as follows: June 1 AVL: 2:22 PCL June 2 AVL: 2:22 PCL June 3 AVL: 2:22 PCL June 4 OFF: 2:22 PCL June 5 INV: 2:22 PCL

for a 30 day month according to sec. 3-2 , 2:22. For months that have 21 days its 2:17.

Please look back at your pay stubs and white pay sheet and highlight where this is occurring and send it in with a note to the MEC, Fax: 412-262-2310 Teddy Xidas.

We will be grieving both issues and need proof of how these wrongful charges are effecting our group and violating our CBA.

Please fax as much information as you possibly can so we can make our case to the arbitrator.
