EQUIPMENT SUBSTITUTION 'PRIOR TO REPORT' ON TRIPS THAT CONTAIN AN EXTRA POSITION

The contract does not address equipment substitution prior to report. The contract does address what happens after report and after origination with respect to the number of available jumpseats and the use of seniority to be removed and pay protected for a trip or portion of a trip during which an equipment downgrade occurs.

In the case of a trip in which the "core" pairing and the "extra" pairing contain the exact same flight segments, the Company has used seniority among the "core" paring and the "extra" pairing and removed the most senior Flight Attendant from the combination of the "core" and "extra" pairing.

After receiving complaints and concerns from flight attendants working the extra position on aircraft that does not require an extra position, the Company and the Union (The Master Executive Council) have come to an understanding of what should occur when there is an equipment substitution prior to report on a trip that contains an extra position. The extra position will be removed and pay protected.

To demonstrate, the following examples are provided:

EXAMPLE #1 BOTH THE "CORE" AND "EXTRA" PAIRINGS ARE IN THE SAME DOMICILE

PAIRING 1234 PHL FAD (core)
67 1500 PHL - SJU
67 1501 SJU - PHL

PAIRING 4321 PHL 76M (extra)

67 1500 PHL - SJU
67 1501 SJU - PHL

If prior to report the 767 is downsized to a 757 the extra position would not be needed and the extra would be removed and pay protected for the value of her/his pairing.

EXAMPLE #2 THE "CORE" AND "EXTRA" PAIRINGS ARE IN DIFFERENT DOMICILES

PAIRING 1111 CLT 757/767 (core)

67 1500 PHL - SJU
67 1501 SJU - PHL

PAIRING 2222 PHL 76M (extra)

67 PHL - SJU
67 SJU - PHL

If, prior to report, the 767 is downsized to a 757 the extra position would not be needed and the extra would be removed and pay protected for the value of her/his pairing.

The reason the extra Flight Attendant would be removed and not the most senior Flight Attendant among both the "core" and "extra" pairings is because the extra position is not required on the 757.

After considering the concerns of our members, the MEC voted 5-0 in favor of removing the extra position to match the company's practice of not covering the position in the first place, if they know the day before that a downsizing of equipment is going to take place. In other words, if the extra position was open the day before the trip was to originate and it was known to Crew Scheduling there would be an equipment downsize from the 767 to the 757, for example, Crew Scheduling would not cover the extra position since only the four positions are needed on the 757.

To reiterate, the extra will be removed if the downgrade in equipment is known prior to report only. In cases after report but prior to origination or after origination the current contract language contained on pages 9-24 and 9-25 will still apply.

As a further clarification, the extra will only be removed if the affected pairings contain the exact same flight segment/s. In addition if the extra is a LODO, the LODO position will be removed.

MEC Election Results

On July 6, 2009, the USA Master Executive Council held a meeting at the AFA-CWA International office in Washington, DC. During the meeting elections for the following positions were held. Below are the results of those elections.
