2004 E-Line Grievance Update
MEC
Grievances filed in 2003 and 2004
Unless
noted otherwise the following grievances are now at The System
Board of Adjustments Level, pending Arbitration Dates.
Furlough
/ Moving Expenses
30-99-02-53-03
Company's
violation of Section 5.A. Company refusing to pay moving
expenses to flight attendants displaced. The Company contends,
that these flight attendant's jobs were saved by the Voluntary
Furlough Program. Therefore they are not entitled to moving
expenses.
Sick
Policy
30-99-02-47-03
AFA
requested a hearing, based on the fact that the Company
implemented a sick policy unilaterally, and violated the
language negotiated by the parties in the December 2002
Restructuring Agreement. This grievance is Held in Abeyance
pending the outcome of, the
Sick
Policy Grievance, filed by the Pilot's Union.
Medical
LOA/Sick 14 Days
30-99-02-65-03
This
case has been arbitrated and we are waiting for the
Arbitrator's decision. The company violated Section 8, Section
20, by automatically placing Flight attendants on a Medical
Leave of Absence when a flight attendant calls in sick for a
period
of 14 or more days. Arbitration date: Dec. 17, 2003
VSIP
(Voluntary Separation Incentive Package)
30-99-02-75-03
AFA
requested a hearing on the company's violation of Section 1.E
of the July 2002 Restructuring Agreement. The Company did not
offer a VSIP before they offered a Voluntary Furlough as
outline in the Restructuring Agreement.
Understaffing
Pay
30-99-02-74-03
Violation
of Section 3.F and Section 9.J.1 and 2. I'm sure everyone
understands this grievance, well, except for the Company.
Health
Care Coverage
30-99-02-105-03
AFA
requested a hearing on the Company's violation of the July
Restructuring Agreement, by failing to provide flight
attendants with the same level of coverage provided in the May
2000 Collective Bargaining Agreement as negotiated in the
Restructuring
Agreement.
Side
Letters/Health Coverage
30-99-02-106-03
AFA
requested a hearing based on the Company's violation of the
May 2000 Agreement by removing side letters L-2, L-3, L-6 and
L-8 from the agreement without negotiating their removal with
the union.
Vacation
Matrix
30-99-02-92-03
The
Association requested a hearing based on the Company's
violation of Section 7.D.1. The company did not post the
vacation matrix at the time the vacation bids were
opened.
ACARS
30-99-02-121-03
The
Association has requested a hearing based on the following.
The Company has unilaterally and arbitrarily changed the long
standing past practice of recording block time by requiring
actual aircraft movement to trip the computation of time for
pay purposes. This grievance is being held in abeyance pending
ALPA Grievance #03-01-01
Filler
Days/ Sick
30-99-02-10-04
The
association has requested a hearing based on the company's
violation of Section 7.F. The company is using the flight
attendants filler days to reduce the amount of sick claim,
when a flight attendant uses a filler day and has a sick claim
the same month.
Filler
Days/ Vacation Pay Rate/Swap Vacation Day
30-99-02-11-04
Company's
violation of Section 7D.5 and Section 7F.3e. Flight attendant
bid for a filler days, she had 7 vacation days and I filler
day. The pay should be at the higher rate, but because the
flight attendant swapped the filler (vacation) day with
another flight attendant, the company paid the filler day at
the lower rate.
Involuntary
Furlough, January 15, 2004
On
January 14, 2004 we arbitrated the Company's violation of the
Restructuring Agreement, based on the fact that the Company
felt they did not have to offer a Voluntary Furlough. Both US
Airways and AFA filed in Federal Court. An arbitration hearing
was held in Washington D.C. and the Union prevailed. The
Company had to offer a Voluntary Furlough. Both sides are
working on a resolution. I'm confident our MEC will keep the
members informed on this issue.
The

Our
next Arbitration dates are May 12-13, 2004 with Arbitrator
Joyce Kline. The hearings take place in Crystal City at
Corporate Headquarters. We have a five-person panel (2) AFA
System Board Members, (2) Company Board Members and a Neutral.
