Dear Members,
Your MEC has engaged in numerous discussions with the company in recent weeks
regarding the issue of Unemployment Compensation pertaining to those who have
chosen to participate in the VFLR and VFLR II offerings agreed upon during the
collective bargaining process. While the majority of participants of the June
1 release of the VFLR have been successful in collecting unemployment
compensation, there have been a few isolated cases in which some flight
attendants have been denied benefits. Some of those cases were resolved in
initial hearings and the determination was overturned. There is one
particular case involving a LGA flight attendant that had been initially
denied in writing. A subsequent hearing took place in NYC before an
Administrative Law Judge of the State of New York. The flight attendant was
present and represented by Mr. Rob Wessinger, LEC President Council 82 and Ms.
Teddy Xidas, former MEC President. It was disappointing to say the least, when
the initial determination disqualifying the claimant from receiving benefits
effective June 1, 2005 was sustained on the basis of the information provided
by UTCA (Unemployment Tax Control Associates). UTCA is a third party
company hired by USAirways, based in Springfield, Ma., that is acting on US
Airways behalf to respond to and administer claims against their Unemployment
Insurance Program.
Since the decision was handed down, your MEC has engaged in further discussions with the company in an attempt to reach a resolution to this issue. AFA feels USAirways has had sufficient time to remedy this situation and their failure to do so in a timely manner has prompted your MEC to file a Grievance under the advisement of the AFA Legal department. We are disappointed to inform this membership with only 2 days left to subscribe to the VFLR II that the company has yet to provide a solution to this ongoing problem. You may wish to consider this information in making your decision to participate in this program. Please feel free to contact your Local Councils for any further questions.
