There has been reference to the $10,000 that each VFLR awardee will receive after they sign a release. Please review below a portion of the
"release letter":
What this release means is that you will forever discharge USAirways, Inc., its parent, affiliated corporations and each of their respective officers, directors, shareholders, employees, and agents from any and all claims, liability, demands and causes of action of every nature, kind and character, known and unknown, which have or may have, arisen or accrued prior to the date of execution of the VFLR. Release by reason of my employment with USAirways, Inc, or by reasons of the circumstances surrounding my VFLR and employment with USAirways, Inc., EXCLUDED from this VFL .Release is my right to RECALL pursuant to the Voluntary Furlough Limited Recall Program. This VFLR Release does include, without limitation any and all claims in law or equity under federal, state or local authority based on wrongful discharge, breach of contract, or discrimination based on age, sex, race, color, creed, religion, handicap, disability, pregnancy or national origin, including without limitation any and all claims under the Americans with Disabilities Act and the Age Discrimination in Employment Act, and claims for employment, back pay, salary continuation, seniority, LPP benefits or any other benefits, damages, attorney's fees and other costs or nay other payments specified in the "voluntary Furlough Limited Recall Program" except for any rights to RECALL. I further agree that this VFLR Release shall be binding upon myself my legal representatives (including the AFA), heirs, successors, and assigns.
By signing the VFLR Release, I acknowledge that I have had at least 45 days to review and consider the terms of this VFLR Release and that I have had an opportunity to have the VFLR Release and that I have had the opportunity to have this VFLR Release and the terms of the "Voluntary Furlough Limited Recall Program" explained to me by an attorney or financial advisor if I so choose and that I understand fully all of the terms of the VFLR Release.
I understand that I have up to seven (7) days after executing this VFLR Release to revoke the VFLR Release and thereafter I intend to be fully bound by the terms of the VFLR
Release.
Translation: What this means is that you are receiving $10,000 payment which releases USAirways of all litigation, potential litigation and legal claims by your signature. When you speak to an Unemployment Representative and he asks you if you received "severance" or a "buy-out" package associated with the VFLR, the answer is NO. Only if he/she asks: The $10,000 is a payment for release of all potential or present claims against the USAirways, Inc.
When you apply for unemployment, only answer questions from the Unemployment Representative that are posed to you to the best of your ability.
