COURT UPDATE

The bankruptcy court reconvened this morning in Alexandria, Va. to hear more testimony regarding the company’s section 1113e “interim” relief request. Company and Union attorneys continued their case before the Judge Stephen Mitchell.  No decision was reached and the Court recessed this evening to resume at 1:30 pm Thursday. I will be attending that session.

US Airways filed a brief with the court stating that it had reached an agreement with the ATSB allowing the Company to continue drawing cash from the federally backed loan to finance operations through January. It is expected the court will approve the plan. The agreement still requires US Airways to maintain weekly cash balances and meet cash projections.  The Company still argues that it needs interim relief and long term cost cutting to survive.  Our belief is that the Company has not negotiated in good faith, as evidenced by their increased demands in each proposal. Perhaps the Court will see it our way. The Company contends that if the Unions win in court the survivability of the Company is in question. I take a contrary view; perhaps it will finally force the Company to negotiate a meaningful agreement that serves their purpose without destroying the lives of its employees.
