THAT I REPORT THE FOLLOWING:
MASSPORT OFFICIALS HAVE DENIED THE PERMIT FOR INFORMATIONAL PICKETING ON OCTOBER 31ST AT TERMINAL B US AIRWAYS - CITE SECURITY THREAT LEVEL 3 / CODE ORANGE
Below is a timeline and correspondence between myself and Mr. Wilfred Suozzo, Massport Airport Security Enforcement & Compliance Manager -
September 28, 2006 a voice mail message was left on Fred Suozzo's line followed with the below e-mail.

I am writing to request a permit for an informational picketing day at Logan Terminal B / US Airways. The date of the permit use is October 31, 2006. I will follow up with a phone call or you may contact me at your earliest convenience at the below contact numbers.
I am assuming that we must meet to discuss prior to providing the permit, like we did in the past for 'Leave on Blades Behind' informational picketing in January/06. I look forward to your response.

Fred Suozzo contacted me via telephone on September 29TH , 2006 and we discussed the request for a permit and it's purpose. He advised and I agreed to contact him with finalized details a week or so prior to the informational picketing as it will require a meeting w/State Police Major Pere and himself. He also advised that after meeting the process will take about 48 hours for me to receive the permit.
At no time during this conversation did Mr. Suozzo advise that he saw a problem in obtaining a permit. On the contrary, he felt it should not be a problem but the procedure of meeting still had to take place.
I have attended a meeting such as this in the past when I requested a permit for the "Leave All Blades Behind' informational picketing in January 2006 and was familiar with this procedure.
As evidence below, I e-mailed Mr. Suozzo providing my availability and requesting him to get back to me with a convenient time. Mr. Suozzo phoned me later on Tuesday to advise that the week selected was no problem and he would get back to me with the selected day and time.

I was wondering if you had availability the beginning of next week to meet to discuss obtaining a permit for the Informational Picketing we would like to do at Terminal B US Airways on October 31, 2006. I will be able to provide the timeframe, the pamphlets we would like to distribute and should have an approximate head count of participants.
The only day I will not be available next week is Thursday, October 26th as I will be attending a meeting in Pittsburgh. Please let me know at your earliest convenience of a time suitable for you as mentioned in our earlier conversation the permit process takes approximately 48 hours. Look forward to hearing from you.

Mr. Suozzo contacted me Wednesday October 18th , 9:10 am and advised that due to the security threat level (3) orange, Massport could not issue a permit for picketing activities at Logan. I questioned this decision and advised the airport in PHX/PHL/DCA/PIT/LGA all allowed picketing and what separated BOS/Logan from these airports. He verbally offered the explanation below. I asked that he please put this in writing. He offered no explanation when asked why he was not aware of this information when I contacted him previously. All he offered was, if the level goes below 3, we will be able to go through the process of obtaining a permit. I questioned if NWA was allowed a permit. He advised NWA did make a request but he did not receive a follow up phone call from NWA and a permit was never issued. Below is his e-mail.

I would like to follow up on our conversation. As I stated, Massport has an approved security plan that limits or restricts certain activities as the National Security Threat Level increases. Our approved plan prohibits leafleting and picketing activities at Logan Airport when the National Security Threat Level is at code orange. At this present time we are at code orange, and therefore, we can not issue a leafleting/picketing permit. Once the code level is lowered we will resume issuing leafleting & picketing permits.

We, USA AFA will be in contact with the AFA International Office to question the validity of this decision. Should the result remain the same - BOS /Logan will be the only airport in this 7/base event that will not be allowed to do informational picketing. I will be in contact with the LGA President to obtain information about the LGA event and most likely will travel to LGA to participate in the informational picketing scheduled.
