Hearing Board Decision / US Airways MEC E-line - sent by MECP - Mike Flores
 
Yes, the hearing board has rendered a decision in the case of M Flores v L LeCarre/ J Albers - If you remember there were 6 (six) charges filed by MECP MFlores. The MECP did not have the full support of the MEC in the filing of these charges. The Hearing Board, after hearing testimony from the parties did apply (1) charge - Article X 1.(j.) of the Constitution and By-Laws.
 
After the filing, up until the hearing board decision and currently the JNC has continued to work together professionally and has made some headway without any issues.
 
A lesson learned perhaps is that each member of a "Joint Negotiating Committee" (JNC) should have equal access and opportunity to review documents outside of negotiations. No one member of a JNC should be accepting terms that would ultimately treat other members of the JNC disparately. Each member of a negotiations committee has signed a confidentiality agreement and is expected to hold any discussions, proposals etc. in confidence if requested to do so. ( In this case, no member of the JNC released any information pertaining to the USAPA Scheduling Proposal) No member of a negotiations committee should be the 'gatekeeper' of documents and be the only one to reference the material more than or at any time outside of negotiations. Should any party providing documents to one member of a JNC for review and state terms which would prohibit equal access, then new terms need to be reached prior to any one member of a JNC accepting any documents.
 
So clearly all of the events were preventable but when an uneven playing field is created in an environment where equality is utmost, issues may arise.
