Dear Members,
 
NOTICE to Voluntary Furlough Flight Attendants
 
Under the American Recovery and Reinvestment Act of 2009 -
should you not have medical coverage by another party i.e.
spouse/domestic partner - we have been advised that you would be
entitled to the COBRA subsidy - of only paying 35% of your COBRA
coverage while out on voluntary furlough. Go to
www.dol.gov/COBRA  - IRS 2009-27 defines voluntary termination.
 
According to the Department of Labor and the Employee Benefits
Security Administration if the company denies this COBRA
subsidy, the employee may file an appeal with the Department of
Labor. The company is currently investigating this situation
that was brought forward after an investigation by both the AFA
MEC Benefits Chairperson Paul Frishkorn and C69 LECP. After a
discussion between C69 LECP and an Employee Benefits Security
Administration advisor in the Regional Office, he advised of the
IRS document 2009-27 detailing the definition of qualifications.
This information was provided to the AFA MEC Benefits
Chairperson who spoke to his contact at the Department of Labor
yesterday to reconfirm all.
 
The company may be hanging their hat on the verbiage ' voluntary
termination' but the definition is clearly spelled out in the
IRS document. CONNEXIS, who will be administering COBRA for the
VF F/A advised that US Airways decides who is covered and who is
not. As the Q & A on their website regarding the COBRA subsidy
does not offer a definition of 'voluntary termination' or does
not direct the employee to the IRS 2009-27 document to review
more detailed information.
 
The AFA MEC Benefits Chairperson has also discussed this
situation with the AFA International Benefits Attorney and will
be providing more detailed information as it becomes available.
